Quick Overview

Losing your job in Italy triggers several important rights and deadlines. Italian workers terminated involuntarily (licenziamento) are generally entitled to NASpI unemployment benefits - up to 75% of previous salary for up to 24 months if they have at least 13 weeks of contributions in the last 4 years. You must register as unemployed (DID) with the Centro per l'Impiego and apply for NASpI within 68 days of termination. Your employer must pay accumulated TFR (severance), final salary including unused vacation (ferie), ROL, and proportional tredicesima. Notice period (preavviso) varies by seniority and CCNL - typically 15 days to 4 months. Unfair dismissals can be challenged within 60 days by registered letter, followed by lawsuit within 180 days.

How It Works

Lost Job on Work Visa in Italy

Italian employment law provides strong protections for terminated workers, though 2015 Jobs Act reforms reduced some guarantees. When you're terminated, first verify the dismissal type: licenziamento per giustificato motivo oggettivo (business/economic reasons), licenziamento per giustificato motivo soggettivo (performance/conduct reasons), or licenziamento per giusta causa (serious misconduct - immediate firing with no notice). Your employer must provide written notice (lettera di licenziamento) explaining the reason. Check your contract and CCNL for the required notice period (preavviso) - typically 15 days to 4 months based on seniority. The employer can pay indennità di mancato preavviso instead of working the notice. If terminated involuntarily, you're likely eligible for NASpI (Nuova Assicurazione Sociale per l'Impiego) unemployment benefits. Register immediately as unemployed by filing DID (Dichiarazione di Immediata Disponibilità) at the Centro per l'Impiego or online via ANPAL. Then apply for NASpI through INPS within 68 days - benefits are typically 75% of average salary up to a base amount (~€1,227/month) plus 25% of the excess, capped at approximately €1,470/month, decreasing by 3% per month starting from month 7. Duration is half your contribution weeks in the last 4 years, up to 24 months maximum. You'll receive your accumulated TFR, final paycheck including all unused vacation days, ROL hours, proportional tredicesima/quattordicesima, and any other amounts owed. If you believe the dismissal was unfair or procedurally incorrect, you have 60 days to challenge it via registered letter (impugnazione), followed by 180 days to file lawsuit. Jobs Act rules apply differently based on when you were hired - pre-2015 hires have stronger reinstatement rights.
