Deposit too high, demanded too early, and uninvested
RISKThree Kaltmieten is the maximum, you may pay it in three monthly instalments, and it must be held separately and earn interest (§ 551 BGB). All three parts of this clause fail.
Redecoration clause is void
RISKRigid deadline schedules and an obligation to hand the flat back freshly decorated regardless of condition are void under settled BGH case law. Where the clause is void, the landlord bears the whole obligation.
Blanket subletting ban
CHECKWhere a legitimate interest arises after you move in, you can require consent to sublet part of the flat (§ 553 BGB). A flat ban cannot override that.
